033007: ETPI is against Zenith

EASTERN Telecommunications Philippines Inc. (ETPI) is opposing an application of Zenith Telecommunications Co. for a permit to operate a radio communications network that will offer data communications services.


In a filing yesterday with the National Telecommunications Commission (NTC), ETPI said Zenith’s application lacks crucial data. Zenith, it added, failed to prove that there exists a real public convenience and necessity for the construction, installation, maintenance and operations of another radio communications network.


“As one of the basic requirements for the grant of CPCN (certificate of public convenience and necessity), public convenience and necessity exists when the proposed service meets a reasonable want of the public and supply a need which the existing facilities do not adequately supply. Thus, any applicant for a CPCN must comprehensively demonstrate public want and the accompanying inability of current carriers to satiate its want,” said ETPI.


ETPI, one of the oldest phone firms in the country, also said that Zenith’s application will unduly restrain the financial viability of the carriers which are currently providing similar services. “There is no immediate, nor even a foreseeable, public need that this application would address as the limited market  is more than fully satisfied by existing operators, including ETPI,” it added.


If the NTC grants Zenith’s application, ETPI said this would only be a wasteful duplication of service, and would result in an unproductive use of scarce frequency spectrum and financial resources.


“There already exist duly-enfranchised and duly-authorized entities which operates radio communications network that offer data communication services in the country…It is respectfully prayed that the application be dismissed for lack of factual and legal basis,” ETPI said.
